on what grounds are NOT entitled to compensation. The players are called UPGRADES they clearly are not. Players have bought them under false pretenses. Its open and shut. WE can argue over what the compensation will be,but IF you can refund cheats, then it must be trivial to refund honest gamers who have been misled.

    - Full $$ refund for FP spent
    - pack compensation for all users
    - discount on FIFA 17

should be the bare minimum. Think of the celebrities that have marketed and endorsed this game. Think of the revenue that has been generated under false information

    This is a major issue

Mens Rea- As an element of criminal responsibility, a guilty mind; a guilty or wrongful purpose; a criminal intent. Guilty knowledge and wilfulness.

You’d have to prove intent and motive. Done on purpose for a gain. What was done, to what advantage?

Or negligence- era or harm due to inappropriate or gross negligent actions relative to harm.

So has anyone on this forum actually pressed this further legally or is everyone still sitting around talking about it?

Never realised how many lawyers were on this forum

I mean if you consult an actual lawyer and they recommend pursuing it, and if your expenditures on FP are great enough, I say go for it. Just keep in mind your potential legal costs, and the high likelihood of failure.

There's always the chance of an "undisclosed settlement" with no admission of fault, which is to say some partial refund. Who knows.

I don't think anybody on here has the legal knowledge to say one way or the other whether there's any point to pursuing it.

It's in their best interest to tell you to pursue it. They already know you're a moron. He's going to turn you into a nice fat roast and slowly grind out a nice fee while the case gets delayed continuously until it's thrown out.

According to some of the news sites that reported this the other day EA make approx $650 million per year from Ultimate Team

Yeah, you don't understand. They would have made those millions anyway.

To what advantage was it to purposely code the IF that way. That's what you would need to prove. With intent and why? If that can be proved, you'd have a case. You don't get charged with robbing your own house just because you left the back door open.

Anyone considered taking their complaints to Ombudsman Services? Pretty sure they provide a service specific to consumers.

Seeing as it's a free to use might be worth a shot.

the argument could be made that the coding "mistake" hurt them by having IF's under preform, causing less people, my self included, to buy them.

On the other hand it could be stated that under preforming IF's could cause people to buy additional IF's, in search of the right one.

    Which argument is more likely?

Yea, they made millions off false advertisement, on purpose or not I don't see how that can be legal, I haven't a clue about the law but to me it seems ridiculous if they get away with it.

To further this point, this is somewhat similar to the VW emissions issue. Customer's cars worked fine, but the cars passed falsely under a bureaucratic emissions regulation. End result was a multi-billion dollar settlement and all car buyers could get their cars purchased back at original value.

Yeah, that's not how it works. Plus, VW admitted woeful and willing deception for gain, after it was uncovered.

    go for it,
i'm willing to donate at least $300 if that helps,
it's not all about money.. it's about justice,
ea scammed us for years and some of these sheeps saying 'ea is multi-billionaire company so they can do whatever they want... so 🎃🎃🎃🎃 and just eat what they feed you' attitude is freaking ridiculous,

The problem is EA know that people are still going to play and buy packs. The only real way to get a refund would be for a huge percentage of us to not play. EA would then take things seriously. We all know that is not going to happen. The morally right thing to do would be a refund and a real explanation of how things work. That would be the medium term solution to rebuild trust. The short term one is more likely. Limited admission. Vague time lines. Limited info and no real compensation

i'm sure we all have a feeling that ea would never do such a thing,
and that's why they have been voted the worst company,
and they have guts to complain and whine saying 'we don't 🎃🎃🎃🎃 understand why they voted us the worst company!!! they hate us for no apparent reasons!!!'
get a freaking grip for 🎃🎃🎃🎃's sake.

The only way to hurt EA is not buy their products. Unfortunately people are going to continue to buy Fifa. So its going to be patched and swept under the rug...I'm surprised there hasn't been a big social media movement to boycott Fifa 17. No point suing.. it ain't going to work. Fifa 16 is finished anyway. What a disappointment of a game.. The scripting BS that came to light was the icing on the cake

Um....what does the release of 17 have to do with anything?

That ppl will stop give a **** about Fifa 16

that "ppl" don't care about 16 in the near future is irrelevant to the discussion of legal action.

Nail of head!! Unless there was a large coordinated complaint filed with large social/media attention, there is no reason for EA to take any remedial action (except fix/cover up bug). They've probably made a pretty penny from FIFA '17 orders, they'll make even more pennies with FP being sold now and through '17. I'd imagine even if everyone on this forum boycotted '17, would they really feel it? My guess is probably not, still millions out there who will buy the game, but the FP and still be unaware of the bug (and many who WILL be aware of the bug!).
